Terms and conditions of our services
1. Introduction
Welcome to Living Up! We appreciate you taking the time to read these Terms and Conditions of Service (the “Terms”), which govern the use of our platform, including our websites, booking engines, and other digital tools (collectively, the “Service”).
These Terms, together with the reservation confirmation sent by email (the “Booking Confirmation”), constitute the legal agreement between you and Living Up (“we”, “us”, “our”). They also govern any interaction or communication you maintain with us through the Service.
By using the Service or making a reservation, you expressly accept these Terms. If you do not agree with them, please refrain from using the Service. We reserve the right to modify the Terms at any time for operational, legal, or security reasons. Continued use of the Service after such modifications implies acceptance of the updated Terms.
2. Definitions
Service: Our websites, booking engine, and digital tools.
Travel Provider / Host: Living Up or the owners of the managed units offering the accommodation.
Travel Services: Accommodation and additional services provided at our properties.
Content: Texts, comments, images, videos, and any material shared through the Service.
User or “You”: The person who accesses or uses the Service.
3. Rules and Restrictions
Each property managed by Living Up may have specific rules (house rules, quiet hours, pet policies), which must be accepted at the time of booking. Failure to comply with these rules may result in reservation cancellation, forfeiture of amounts paid, or denial of access to the accommodation.
4. Use of the Service
The Service is intended solely to allow the search and reservation of stays for personal use. By using it, you represent that:
You are at least 18 years old and have the legal capacity to enter into contracts.
You provide accurate and up-to-date information.
If you make a reservation on behalf of a third party, you have their authorization and are responsible for ensuring they comply with these Terms.
It is strictly prohibited to make fraudulent reservations, use automated software to extract data, or interfere with the proper functioning of the website.
5. Booking Confirmation
You will receive a Booking Confirmation containing the essential details of your stay. If you do not receive it within 24 hours, please contact us immediately through our official channels.
6. Prices, Payments, and Taxes
Prices: Prices are dynamic. We reserve the right to correct obvious pricing errors; in such cases, you may pay the corresponding difference or cancel the reservation without penalty.
Taxes: Prices include applicable taxes (VAT and Lodging Tax). Certain municipal fees may be charged separately in accordance with applicable regulations.
Payments: You authorize the verification of your payment method. Any international transaction or currency conversion fees will be the responsibility of your financial institution.
7. Fraud and Security
If suspicious activity is detected, Living Up may cancel the reservation or request additional information to validate the identity of the payment method holder.
8. Changes and Cancellations
By the User: Modifications are subject to the cancellation policy selected at the time of booking. Administrative fees may apply.
By Living Up: We may cancel a reservation due to non-payment, technical errors, or force majeure events (including weather-related events), offering alternatives or refunds as applicable.
Refunds: Refunds will be processed to the original payment method within up to 7 business days. Charges for services already rendered may be non-refundable.
9. Stay-Specific Conditions
Security Deposit: Some units require a refundable security deposit at check-in.
No-Show: Failure to show up on the first night without prior notice may result in full reservation cancellation with no refund.
10. International Travel
Guests are responsible for holding valid passports and visas and for complying with immigration and health requirements to enter Mexico. Living Up shall not be responsible for issues arising from incorrect or incomplete documentation.
11. Intellectual Property
All website content (logos, apartment photographs, texts) is the property of Living Up or its licensors. Any unauthorized use, copying, or reproduction is strictly prohibited.
12. User Security and Fraud Prevention
Our team will never request transfers to personal bank accounts via text messages or payments using gift cards. All transactions must be carried out exclusively through our official booking engine or authorized payment methods provided by Living Up.
13. Artificial Intelligence and Digital Tools
We may use artificial intelligence tools to improve customer service or generate descriptions. Such content is for informational purposes only and is used at the user’s own responsibility.
